RESOLUTION NO. 2026-3

 A RESOLUTION AUTHORIZING THE CONDUCT OF A MAIL BALLOT

ELECTION FOR THE TOWN OF HOLLY'S REGULAR MUNICIPAL ELECTION

AND/OR SPECIAL ELECTION, SETTING FORTH DETAILS IN RELATION THERETO

WHEREAS, the Town of Holly, Colorado (the "Town"), is a municipal corporation duly organized and operating as a statutory town under the Constitution and laws of the State of Colorado; and

WHEREAS, Section 31-10-102.7 C.R.S. permits a municipality to utilize the requirements and procedures of the Uniform Election Code of 1992 with respect to any municipal election; and

WHEREAS, the Town Board wishes to adopt a portion of the Uniform Election Code of 1992 relating to mail ballot elections for all Regular Municipal and Special Elections; and

WHEREAS, Section 1-7.5-104, C.R.S. provides that the governing board of any political subdivision may determine that an election may be held by mail ballot; and

WHEREAS, the Town Board wishes to conduct all Regular Municipal and Special Elections from the date of adoption of this Resolution, as a Mail Ballot Election.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF HOLLY,, COLORADO, AS FOLLOWS:

Section 1._Adoption of the Mail Ballot Election Provisions of the Uniform Election Code all Regular Municipal and Special Elections. The Town of Holly hereby adopts the mail ballot election provisions of the Uniform Election Code (C.R.S., Title 1 Article 7.5, also known as the "Mail Ballot Election Act") pertaining to mail ballot elections for the conduct of all Regular Municipal and Special Elections. In the event procedures for the election are not provided for in the Mail Ballot Election Act, the Town shall comply with the Municipal Election Code (C.R.S. Title 3 1, Article 10) or applicable Town ordinances and regulations.

Section 2. Election Plan. The Town Clerk is hereby authorized to forthwith submit to the Secretary of State a proposed plan for conducting the mail ballot election pursuant to the Mail Ballot Election Act and to follow the other procedures in the Act with regard to the conduct of the election.
